By accessing or using Onboard Tutor’s services, website, or learning platforms, you agree to be bound by these Terms of Use.
These Terms contain:

If you do not agree, you must not use our services.
1. ABOUT ONBOARD TUTOR
Onboard Tutor (“we”, “us”, “our”) provides academic tutoring, educational support, and related learning services to students (“Learners”) in South Africa.

2. DEFINITIONS
For purposes of these Terms:
Platform means any website, WhatsApp channel, online classroom, or digital system used by Onboard Tutor.
Learner means the student receiving tutoring.
Client means the parent, guardian, or person responsible for payment.
Tutor means any educator providing services through Onboard Tutor.
Services means tutoring, academic support, assessments, and related offerings.
3. ACCEPTANCE OF TERMS
By:
booking lessons
registering a Learner
using our Platform
or making payment
you confirm that you:
have read these Terms
understand them
agree to be legally bound
If you act on behalf of a Learner, you confirm you have authority to do so.
4. NATURE OF SERVICES
Onboard Tutor:
matches Learners with Tutors
provides academic support
offers online and/or in-person lessons
Important:
We do not guarantee specific academic results, as performance depends on learner effort, attendance, and external factors.
5. USER ACCOUNTS AND INFORMATION
You agree to:
provide accurate information
keep contact details updated
maintain confidentiality of login details
notify us of any unauthorised use
We may suspend access if information is false or misleading.
6. FEES AND PAYMENT
6.1 Fee Structure
Fees are communicated at enrolment and may be:
hourly
per package
monthly
6.2 Payment Terms
Payment is due in advance unless agreed otherwise.
Late payment may result in lesson suspension.
6.3 Non-Payment
We reserve the right to:
pause lessons
withhold reports
terminate services
for overdue accounts.
7. CANCELLATIONS AND RESCHEDULING
Client Cancellations
Minimum 24 hours’ notice required.
Late cancellations or no-shows are charged in full.
Tutor Cancellations
If we must cancel due to illness or emergency, we will:
reschedule, or
provide a make-up session.
8. ONLINE LESSON REQUIREMENTS
Clients must ensure:
stable internet
working camera/microphone
suitable learning environment
Onboard Tutor is not responsible for client-side technical failures.
9. CONDUCT AND SAFETY
Learners must:
behave respectfully
follow tutor guidance
avoid disruptive behaviour
We may terminate services for serious misconduct.
For in-person lessons involving minors, a responsible adult must be present unless otherwise agreed.
10. INTELLECTUAL PROPERTY
All materials provided by Onboard Tutor — including:
worksheets
notes
recordings
assessments
remain our intellectual property.
You may not:
copy
distribute
sell
or upload
these materials without written permission.
11. USE OF TECHNOLOGY AND AI
We may use educational technology and automated tools (including AI) to:
support learning
generate summaries
improve services
These tools may operate with limited human oversight.
12. LIMITATION OF LIABILITY
To the fullest extent permitted by South African law:
Services are provided on an “as available” basis.
Onboard Tutor is not liable for indirect or consequential loss.
Our total liability is limited to fees paid for the affected service.
Nothing in these Terms excludes liability where unlawful to do so.
13. TERMINATION
Either party may terminate with one month’s written notice.
We may terminate immediately for:
non-payment
misconduct
breach of these Terms
safety concerns
14. CHANGES TO TERMS
We may update these Terms from time to time.
The latest version will be made available to clients.
Continued use of the Services constitutes acceptance of the updated Terms.
15. GOVERNING LAW
These Terms are governed by the laws of the Republic of South Africa.
PART B — POPIA PRIVACY POLICY
16. POPIA COMPLIANCE
Onboard Tutor complies with the Protection of Personal Information Act (POPIA) and is committed to protecting personal information.
17. INFORMATION WE COLLECT
We may collect:
Learner name and surname
Parent/guardian details
Contact information
School and grade
Academic records
Payment information
Relevant medical information (if voluntarily provided)
Lesson recordings (where applicable and disclosed)
18. PURPOSE OF PROCESSING
We process personal information to:
provide tutoring services
communicate with clients
schedule lessons
monitor progress
process payments
comply with legal duties
19. LEGAL BASIS (POPIA)
Processing is based on:
consent
contractual necessity
legal obligation
legitimate educational interest
20. INFORMATION SHARING
We do not sell personal information.
We may share information with:
assigned tutors
secure payment providers found in South Africa
regulators where legally required
All parties must maintain confidentiality.
21. DATA SECURITY
We implement reasonable technical and organisational safeguards to protect personal information against:
loss
unauthorised access
misuse
unlawful disclosure
22. DATA RETENTION
Information is retained only as long as necessary for:
educational purposes
legal compliance
record-keeping
After this, it is securely deleted or anonymised.
